It feels kind of weird to be following the lead of the mainstream when it comes to the behaviour of Kathy Jackson, but given they are on the same page as me now and they have far greater resources I guess I’ll become accustomed to it.

However the revelations that have surfaced this week regarding her are nothing really that new, just some extra details on what the member’s money was being spent on by Jackson.

Some of those details however seem to indicate a union secretary on permanent vacation at the members expense.

On 1st August I gave a tally on questionable spending that I was aware of by Jackson which totalled approximately $1.7 Million. At the time I mentioned that some of the $1 Million dollars in credit card expenditure would have been legitimate spending, now we are starting to see details on some of it that allegedly wasn’t.

Evidence presented to the Federal Court shows some expenditure that union members allegedly footed the bill for was on Jackson’s family holidays. These included multiple trips to Hong Kong, New Zealand, Port Douglas, the Gold Coast, and multiple ski trips to Falls Creek and Mt Buller.

I wonder if Fair Work Commissions Tony Abbott appointed Vice President Michael Lawler took any of these member funded trips with her.

This new evidence formed part of the HSU National Offices claims against Kathy Jackson for civil damages before Federal Court this week.

With the new credit card expenditure evidence the total civil claim against Jackson is approximately $1.4 Million.

At the time of publication Wixxyleaks has cited the evidence in the Federal Court matter but for legal reasons cannot publish them in full as yet.

With Kathy Jackson facing this much in civil claims, maybe the disgraced ex shock-jock and blogger Michael Smith should start looking for a new granny flat to bunk in…

Other Jackson expenditure includes wild spending at the member’s expense at retailers such as Myer, David Jones, Safeway, Vintage Cellars, Harvey Norman Electrical, Betta Electronics, JB Hi-Fi, L & L Shoes, Seed Clothing Store, Ted’s Cameras, Borders Books and Music, RG Madden Giftware, Bed Bath & Table, Poppyshop, Babystitch, Downtown Duty Free and Kleen Design.

Kathy Jackson also stands accused of double-dipping on her annual leave by claiming a total of 1318 hours twice. Maybe all that spending was such hard work she thought she needed extra holidays.

Also part of HSU Acting National Secretary Chris Browns affidavit was a list of cash cheques Jackson had allegedly withdrawn from the HSU #3 Branch account. In under three years between 2007 and 2010 these cash cheques totalled $230,037, the bulk of these cheques were drawn allegedly without the BCOM approval Jackson has usually relies upon to dodge responsibility.

Bear in mind this total is from a separate account to the NHDA account Jackson has sole access to which contained the $250K she received from Peter MacCallum Cancer Hospital so the hospital could avoid paying workers $3 Million in unpaid entitlements. This means the $230K in cash cheques does not include the two cheques Jackson gave to her ex-husband for $50K and $58K.

According to Brown’s affidavit some of the cash cheques were used to help pay for holidays, and some went into Jackson’s mortgage account.

Five of these cheques totalling $24,000 during 2008 were actually signed by Kathy Jackson whilst she was not an employee of the branch let alone an officer of the branch. It may as well have been me signing the cheques for all the authority she had.

This time in Federal Court  there was no phone-ins from Michael Lawler while birds sang in the background. Jackson was once again a no-show and nobody showed up on her behalf in person, via phone, or via Skype.

Jackson claimed to have been sick, something impending doom and bankruptcy often brings on. Mark Irving appearing for the HSU wasn’t so sure about the sudden illness given Jackson has failed to comply with court orders 17 times so far.

So what’s next?

Well Jackson has until October 10th to make a submission to the court, and then on 14th October she is due to face the Federal Court. Maybe this time she may grace them with her presence.

The HSU has made application for a summary judgement on the matter which may leave Jackson facing around $740K in civil claims payable to the HSU.

If a summary judgement is granted by the court it is then expected that the matter will then be referred to Victoria Police for criminal investigation.

If the summary judgement is granted it is also expected that the $660K in credit card expenditure will be referred to fair Work Commission to retrieve on the unions behalf, once again putting Vice President Michael Lawler in an awkward position. If the summary judgement is not granted it will likely be added onto the civil proceedings before the Federal Court which will then total around $1.4 Million.

This is substantially more than the combined sums of those Jackson claims to have blown the whistle on.

For those of you who think that this new information on credit card expenditure is the evidence Jackson was seeking to keep suppressed from Chris Browns witness statement, think again. This is not what we are awaiting on the Royal Commission to decide whether they will put into evidence.

This of course means that there are even more allegations yet to emerge relating to Kathy Jackson’s behaviour.

Many people who I have spoken with suspect that Kathy Jackson would be currently working hard on how to hold onto the money by shifting it around, most believe that she will attempt to put it into her partner Michael Lawler’s name to avoid giving it back to union members that she allegedly ripped off without a passing thought.

The irony of this is not lost on me.

Rewind the memory back a couple of years to when Craig Thomson was the most poisonous man in parliament.

There we had Tony Abbott, his heart apparently bleeding for the long-suffering members of the HSU and telling everybody with a long face how bad he felt for these workers.

Now that the woman he described as heroic and someone he admired is being taken to task for allegedly defrauding the same members of more than 50 times the amount Thomson is appealing his sentence for.

If she tries to hide the members money via the Tony Abbott appointee Michael Lawler the damage that could be done to Abbott and his government may be irreparable, and the Fair Work Commission may as well close their doors for all the credibility they will be left with.

No matter what happens it will be interesting to see how events pan out. After all it is clear that Jackson may have succeeded in making a mockery of the Royal Commission by avoiding cross-examination on the bulk of allegations against her, but she is running out of excuses and chances in Federal Court.

For union members the 14th of October can’t come fast enough.

    I went back to the Pickering Post and can find no trace of the original story but it may be archived.

    Do you know what is happening here? What was Pickering up to putting out this story that seems to be blatantly untrue.

  4. I have no idea, the post seems to have disappeared from Pickerings site.

    Kathy made allegations a few years back regarding Bill pinning her to a wall and screaming in her face. They were in an affidavit for Federal Court she made and the judge ordered her not to release them to the press and found the whole story unbelievable.

    The affidavit was then leaked to the mainstream press (Kathy blamed her children) however nobody took it seriously so it hardly rated a mention, the only mainstream mention it received was in the Financial Review

    That is the only tall story I was aware of.

    With Jacksons history of throwing mud however nothing would surprise me…

  5. Perhaps someone with legal knowledge can help me with this one. To take a hypothetical case, if person X knows (or even suspects) that his de-facto spouse is stealing from her employer, is person X guilty of anything?

  6. Well, the dress rehearsal is nearly over and the Royal Commission report will probably recommend a number of prosecutions. If they do, then its the DPP’s turn to really turn up the heat. I am tipping Wilson will be a starter for trial and maybe Gillard as an accessory [or conspiracy] due to false info provided to WA Corp Affairs.

    Jackson looks like she should enter an early plea for theft and fraud with former husband and Lawler as accessories. They may join Williamson, so they should take their tooth brush to their sentencing hearings. I would also expect the responsible officers of the Peter Mac Institute to be charged along with Jackson for conspiracy to defraud or something similar.

    Officials of CFMEU look in particular danger of doing time for fraud and extortion.

    But my gut feeling tip is that Thompson will win his appeal. Although I have not read the evidence [my disclaimer] I have always held a view that he can’t be guilty of fraud by using a credit card that was issued in his own name. It was always up to the union to reject payment of the credit card bills. If they did not do that then they can’t complain later. Thompson Not Guilty is my tip. But I won’t bet on it.

    Expect new laws and a permanent commission to control trade union administration similar to laws that apply to corporations. Maybe an ASIC type body with wide powers to ban individuals from office for criminal activity and serious breaches of law. Its the end of slush funds set up and funded by offers of “industrial peace” in our time. Union officials are just going to have find other legal ways of raising funds for re election.

  8. Yep I am 1 who thought this was the Chris Brown evidence KJ didn’t want to face at the RC. With all that is coming out will questions be asked of Vic police investigations especially with the song and dance in front of the media when it came to CT

  9. I think John Overall has given excellent tips for the form. I think Wilson Blewitt and Gillard to have adverse recommendations. Jackson to be charged along with a number of ex and current partners (not Irving though, he made a lucky escape 20 years ago, but should get special mention for courage under fire). CFMEU will probably see Greenfield and Sparkles get guernseys. Alex should just be banged up somewhere for 25 years on anti psychotics and forget about his future work prospects (the major theme of this morning).

    Expect many minor players to get perjury findings.

    In fact it might be easier to name the few people who told the truth, let them leave the building, and then just round up the rest.

  10. I may be needing to apologise here. The original story re ‘Kathy’ and Bill Shorten is on the Pickering Post. No mention of ‘Jackson’ just Kathy and obviously not Kathy Jackson. Now I don’t know if my memory is playing tricks and the surname ‘Jackson’ was never mentioned or if it has been removed. Must admit I found the story after reading it elsewhere and that it was Kathy Jackson making the accusation. I’ll err on the side of caution however and say that I misread the article. Sorry.
